Clerk of Superior court

The Clerk is the person responsible for protecting the integrity of public records and public funds. The Clerk receives, manages, and processes all court documents, collects and disburses all court fees, fines, and costs, and provides the public with access to court records. As keeper of public records, the Clerk records deeds, mortgages, and notaries public. Citizens’ case files, court records, property deeds, and mortgages are handled and protected by the clerk.

District Attorney

Haralson County’s District Attorney is the chief prosecuting officer. He is an elected constitutional officer, who is part of the judicial branch of Georgia State Government. The District Attorney represents the State of Georgia in the trial and appeal of criminal cases in the Superior Court. He is also the legal advisor to the Grand Jury, and performs other duties as prescribed by law.

Juvenile Court

The Juvenile Court serves children and families through prevention and early intervention to divert children and families from Court due to unruly, delinquent and deprivation issues. The Juvenile Court schedules and hears termination of parental rights cases, motions to transfer to Superior Court and transfer of custody cases for reports or orders of determination in a timely manner.

Magistrate Court

The Magistrate (Small Claims) Court handles claims under $15,000 and garnishment actions. You may file a claim in Magistrate Court without an attorney. You may have an attorney represent you, at your own expense, if you choose. The Court does not appoint attorneys for civil cases. Either a person or a business may be sued. The Magistrate Judge also handles bond hearings, determining if the defendant should be given a bond, the amount of the bond and if special conditions should be met.

Probate Court

Haralson County Probate Court establishes the validity of wills, documents the administration of estates, appoints a guardian when none has been established, maintains vital records such as birth certificates, marriage licenses, and death certificates, and issues gun permits. The court also disposes of traffic and game and fishing citations.

Public Defender

The Public Defender's Office represents individuals who are being prosecuted in Superior Court of Haralson County who cannot afford an attorney. To apply for a Public Defender, you must complete a financial affidavit in person at the Public Defender's Office. In order to qualify, you must meet the Federal Poverty Guidelines.
