Should my Claim be brought in Magistrate Court?

The Magistrate Court has jurisdiction to handle civil claims that do not exceed $15,000. A Magistrate judge will hold a hearing to listen and decide each case. Any person or business can be sued.

Do I need an Attorney?

Any person can file a Small Claims Action in Magistrate Court without an attorney. If you choose, you may hire an attorney at your own expense. The court will not appoint an attorney for you.

When deciding if you need an attorney or not, be advised that any Magistrate judge or a clerk of the Magistrate CAN NOT advise you on legal matters regarding your case.
